1. General and definitions
Seller details (complete before trading)
South African consumer law requires clear disclosure of the supplier. Insert your verified details below (or on a linked statutory page) before you accept paid orders:
- Full registered legal name of the seller
- Registration number (if a company or close corporation)
- VAT number (if registered)
- Physical address (not only a P.O. Box, where required)
- Contact email and telephone
Contact (interim): dispatch@therunners.co.za · Contact page
In these terms, "we", "us", and "our" mean the seller operating as The Runners. "You" means the person using the website or placing an order.
By accessing this website, creating an account, or placing an order, you agree to these terms. If you do not agree, do not use the site or purchase from us.
We may amend these terms from time to time. The version on the website at the time you place an order will apply to that order. Material changes will be indicated by updating the "Last updated" date above. Continued use of the site after changes constitutes acceptance of the updated terms where the law allows.
2. Orders and purchasing
Product descriptions, images, and prices on the website are invitations to treat. When you complete checkout and submit an order, you make an offer to purchase the goods in your cart at the prices and delivery options shown.
We may accept or reject an order (for example, if a product is unavailable, there is a pricing or description error, or we suspect fraud). A contract of sale is formed when we accept your offer—typically when we send an order confirmation by email or when we dispatch the goods, whichever we specify in our communications. Until then, no binding sale exists.
Availability. All products are subject to availability. If we cannot fulfil your order (including part of an order), we will notify you and, where you have already paid, refund the amount paid for the unavailable item(s) as soon as reasonably practicable and in any event within a maximum of 30 days unless a shorter period is required by law or agreed with you.
Pricing and VAT. All prices are quoted in South African Rand (ZAR). Unless we state otherwise on the product or checkout page, prices include value added tax (VAT) at the rate applicable in South Africa. Delivery fees are shown separately at checkout before you pay.
Errors. We correct obvious pricing or description errors where we are entitled to do so under the CPA. If an error affected your order, we will contact you with the option to proceed at the correct price or cancel for a full refund of any amount paid.
3. Payment and delivery
Payment. We use reputable payment service providers. Depending on what we enable on the site, you may pay by methods such as card payments or electronic funds transfer (EFT), as shown at checkout. Payment is due before we dispatch goods unless we expressly agree otherwise in writing.
Delivery area. We currently deliver within the Republic of South Africa using the methods offered at checkout. If your area is not serviceable, we will inform you and not charge you, or we will refund any payment taken.
Methods and indicative fees. Options may include door-to-door courier and Paxi pickup-point delivery. Indicative options and fees shown on the site include, where applicable: courier door-to-door at R170.00; Paxi standard (indicative 7–9 business days) at R59.95; Paxi express (indicative 3–5 business days) at R109.95. Timeframes and carrier performance are estimates only; we are not responsible for delays caused by the courier, weather, public holidays, or events outside our reasonable control, but we will assist you in tracking and resolving delays where we can.
Risk and ownership. Risk of loss or damage to the goods passes to you on delivery to the address or Paxi point you provided (or as otherwise agreed with the carrier). Ownership of the goods remains with us until we have received full payment of all amounts due for those goods.
4. Returns and refunds (consumer rights)
Nothing in this section limits any rights you have under the CPA, ECTA, or other applicable law that cannot lawfully be excluded.
Cooling-off (ECTA). Where ECTA applies to your transaction as an electronic transaction, you may have the right to cancel the agreement within seven (7) days after receiving the goods without reason or penalty, subject to statutory exceptions. Typical exceptions include goods made to your personal specifications, personalised or customised goods, goods that cannot be restored or resold (for example because they are used or unsealed where hygiene or copyright applies), perishable goods, and other categories recognised in law. If you cancel in time and the law applies, we will refund you within the period ECTA requires, less any permitted deduction.
Damaged, defective, or incorrect goods. If you receive goods that are damaged in transit, materially defective, or not what you ordered, notify us as soon as possible and in any event within fourteen (14) days of delivery (or within a longer period if the CPA or a manufacturer warranty gives you more time). We will, in line with the CPA, arrange repair, replacement, or refund as appropriate. Where the goods are not as described or are faulty through no fault of yours, we will generally bear reasonable return shipping costs we approve in advance; follow the return instructions we provide.
Change of mind. Apart from statutory cooling-off or other rights above, we may allow returns for change of mind only if we say so on the website or in writing. Unless we agree otherwise, you are responsible for return shipping for change-of-mind returns.
Process. To start a return, contact us via the contact page or dispatch email with your order number and photos where relevant. Do not return goods until we confirm the address and method. Refunds are processed to the original payment method where possible.
5. Privacy and security
We process personal information in line with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Please read our Privacy Policy for details on what we collect, how we use it, security measures, retention, and your rights.
6. Dispute resolution and governing law
These terms and any dispute arising from them or from your use of the website or purchase of goods are governed by the laws of the Republic of South Africa.
We encourage you to contact us first so we can try to resolve your complaint fairly and quickly.
National Consumer Commission. If we cannot resolve a dispute relating to consumer matters, you may lodge a complaint with the National Consumer Commission ("NCC") or other bodies the law designates. Information about the NCC is available from official government sources.
Nothing in this section prevents either party from approaching a court with jurisdiction where the law allows.
